Death Penalty - another perspective

Supreme Court Justice Antonin Scalia made a speech; he argued that anyone who does not think the death penalty is moral should resign from the Supreme Court.
The Constitution does not define morality, however one commonly available definition is in the 10 Commandments. Thou shalt not kill
Presumably, this means thou shalt not kill either directly or through a proxy.
If that is the moral anchor, then Scalia is confusing morality with expedience.
An act, such as capital punishment, may be cost-effective or practical but not moral.
